User Agreement

Any disagreement must be sent to [email protected] within 30 days of that notice; absence of a written objection constitutes acceptance. Parties
Transformation Strategies, LLC d/b/a Job Seeker Pro (“JSP,” “we,” “our”) and the undersigned student (“you,” “your”).
1. Intellectual-Property License & Copyright Notice
1.1 Ownership. All Job Seeker Pro materials—including training videos, slides, the BRAVE 5-Step Job Search course, the SERVE 5-Step Job Promotion course, Flash Training sessions, emails, templates, tools, worksheets, ideas, any future JSP courses or programs, and all other content (collectively, the “Materials”)—are proprietary works copyright © 2022, 2023, 2024, 2025 Transformation Strategies, LLC. All rights reserved. “Job Seeker Pro,” “BRAVE,” and “SERVE” are trademarks of Transformation Strategies, LLC.
1.2 Limited License. JSP grants you a personal, non‑transferable, non‑exclusive license to access and use the Materials for your own job‑search and career development. You may not:
- Share, sell, publish, post, or otherwise distribute the Materials outside the program;
- Create derivative works or incorporate any part of the Materials into another product, service, or curriculum;
- Use the Materials for any commercial, revenue‑generating, or competitive purpose.
2. Payment & 45‑Day Money‑Back Guarantee
2.1 Guarantee Window. You may request a full refund within 45 calendar days of your original purchase date (“Guarantee Period”). If this program was paid for by someone else you are not eligible for any money‑back guarantee.
2.2 Triggering Events. The Guarantee Period ends—and no refunds are available—once you use any personal consulting services, including:
- Submitting materials for a résumé or LinkedIn review;
- Attending or participating in any live weekly group‑coaching session;
- Receiving any one‑on‑one feedback, coaching, or similar personalized service from JSP or its representatives.
2.3 Refund Procedure. Email [email protected] within the Guarantee Period and include either (a) your Venmo username or Zelle email/phone for an electronic refund, or (b) your mailing address if you prefer a paper check. Approved refunds are issued by the chosen method within 10 business days of confirmation.
3. Conduct & Dismissal
We strive for a respectful learning environment. JSP may suspend or dismiss any student—without refund—whose behavior is disruptive, distracting, disrespectful, disagreeable, abusive, or otherwise harmful to the community. Dismissal is exercised sparingly and, when practical, only after reasonable warning.
4. Disclaimer of Results & Personal Responsibility
- Informational Purposes Only. All advice, strategies, and examples are educational ideas for your consideration.
- No Guarantees. JSP does not promise or guarantee any specific job offers, promotions, salary increases, or outcomes.
- Your Decisions, Your Results. You alone are responsible for evaluating each idea and for all decisions and actions you take.
5. Governing Law & Binding Arbitration (Tarrant County, Texas)
Any claim or dispute arising out of or relating to this Agreement or your participation in JSP shall be resolved exclusively by confidential, binding arbitration in Tarrant County, Texas, under the rules of the American Arbitration Association.
- Fee‑ The losing party shall pay all arbitration fees and expenses.
- You waive the right to a jury trial and to participate in any class or collective action. Judgment on the arbitrator’s award may be entered in any court of competent jurisdiction.
6. Comprehensive Release, Waiver, Indemnification & Liability Cap
- Waive and release Transformation Strategies, LLC; Brian Howard; and all affiliated owners, members, officers, employees, contractors, agents, successors, and assigns (collectively, the “Released Parties”) from any and all claims, actions, causes of action, liabilities, losses, damages, or expenses of every kind—known or unknown—arising out of or relating to your participation or decisions.
- Indemnify, defend, and hold harmless the Released Parties from all third‑party claims, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising out of your actions, omissions, or breach of this Agreement.
- Limit Liability. If any liability is nonetheless imposed on a Released Party, the total aggregate liability shall not exceed five (5) times the total program fees you actually paid.
(Nothing in this clause waives liability that cannot legally be waived—e.g., gross negligence or intentional misconduct where prohibited by law.)
7. Access Duration & “Lifetime” Definition
Program access duration is defined at the time of purchase. Some offerings include 90‑day or 1‑year access; others provide “lifetime” access. “Lifetime” means for as long as JSP continues to sell new enrollments for that specific program. Where lifetime access applies, you receive:
- Ongoing access to the specific course(s) (e.g., BRAVE and/or SERVE) you purchased;
- Email support;
- Access to the then‑current Slack (or successor) community;
- Access to the then‑available templates and tools tied to that course.
If a fixed‑term program (e.g., 90‑day or 1‑year access) was purchased, your access ends at the conclusion of that term unless you upgrade or renew.
8. Updates to Terms
These terms may be updated from time to time and will always be available at https://www.jobseeker.pro/user-agreement. Continued participation after any update constitutes acceptance of the revised terms.
9. Miscellaneous
- If any provision is held unenforceable, the remaining provisions remain in effect.
- Entire Agreement. This document constitutes the complete agreement between the parties and supersedes all prior or contemporaneous communications.
- Except as provided in Section 8, any amendment to this Agreement must be in writing and signed by both parties.
